Patent Nedir?

Patent bir icadın, fikrin ve üretim yönteminin mucidi dışında kimsenin üretme, kar sağlama ve kopyalama hakkına sahip olmadığını gösteren belgedir. Bilimsel keşiflere, teorilere, bilgisayar yazılımlarına, sanat eserlerine ve edebi eserlere patent verilmez ve koruma sağlanamaz.

Ülkemizde Patent Nereden ve Nasıl Alınır?

Ülkemizde Türk Patent ve Marka Kurumu’na müracaat edilerek belirli aşamalar sonunca patent alınabilir bu  aşamalar sırasıyla:
1: Başvuru yapılır.
2:Patent vekili buluşunuzun gerçekliği hakkında bir araştırma yapar.
3:Patent vekilinden onay alan buluşun mucidinden buluşun detaylı modeli istenir ve patent vekili tarafından incelenir.
4: Bu incelenme sürecinin sırasında ve sonunda bir patent vekili tarafından “Araştırma Raporu” yazılır bu raporun sonucuna göre patent tarifnamesi, patent sahibine verilir.

Girişimcilikte Patent’in ve Patent Sahibi olmanın önemi nedir?
Patent almanın birinci önceliği bireyin edeceği karı ve pazar payını korumaktır. Günümüz döneminde bilgi sanal meralarda depolanıyor ve sanal mecralar üzerinden işlem görüyor. Bireyler gelecek gördükleri kafalarında oluşan fikirlerin, olabilecek en kısa zamanda patenti almalı çünkü veri hırsızlığı günümüzde çok yaygın yani birey fikrini hız çağı olan günümüzde olabildiğince hızlı tescil etmeli. Patent almanın kinci önceliği bir gelir kapısı olması, otomotiv sektöründe alınan bir patentin değil bireyleri, firmaları ayakta tuttuğunu görüyoruz. GMC olarak da bilinen General Motor Company’nin yıllık gelirinin önemli bir kısmını sahip oldukları patentler sağlıyor.  Aynı zamanda çoğu üst düzey şirket, sadece paten üzerine satın alımlar yapıyor örneğin Google’ın Ar-Ge ve patentleri için Motorola’yı satın alması, Çin otomotiv devi Geely’nin Ar-Ge ve patentler için Volvo’yu satın alması… Bireyler sahip oldukları patentleri şirketlere, kurumlara ve diğer bireylere satarak patentlerinden düzenli yada tek seferlik gelirler elde edebilir. Üçüncü olarak bireyin portfolyosunu oluşturması. Otomotiv sektöründe mühendislik yapmış bir kişinin aldığı patent sayısı ve bu patentlerin söz konusu olduğu buluşların sektördeki yeri, mucidin sektördeki önemini belirtmekte yani iyi ve başarılı olmuş patentlere sahip mucitler kolay yatırım alır, kısaca sektörde daha dikkate alınır.

A patent is a document showing that no one has the right to produce, profit or copy except the inventor of an invention, idea and production method. Scientific discoveries, theories, computer software, works of art and literary works cannot be patented and protected.        

How to Take Patent in Our Country and How ?

A patent can be obtained at the end of certain stages by applying to the Turkish Patent and Trademark Office in our country. The Steps are :

1: Application is made.

2: The patent attorney conducts a search on the authenticity of your invention.

3: Detailed model of the invention is requested from the inventor of the invention, which is approved by the patent attorney, and it is examined by the patent attorney.

4: During and at the end of this examination process, a "Research Report" is written by a patent attorney. According to the result of this report, the patent description is given to the patent owner.
                       

What is the Importance of the Patent and Being Patent Owner in Innovation ?

The first priority of obtaining a patent is to protect the profit and market share of the individual. In today's era, information is stored in virtual pastures and processed through virtual channels. Individuals should get the patents of the ideas that are formed in their minds as soon as possible because data theft is very common today, that is, the individual should register his idea as quickly as possible in today's age of speed. The second priority of getting a patent is that it is a source of income, we see that not a patent obtained in the automotive sector, but it keeps individuals and companies alive. The patents they own provide a significant portion of the General Motor Company's annual revenue, also known as GMC. At the same time, most top companies make purchases only on skates, for example, Google purchasing Motorola for R&D and patents, Chinese automotive giant Geely buying Volvo for R&D and patents. It can earn regular or one-off revenues from its patents by selling the patents to companies, institutions and other individuals. Third, the individual creates his / her portfolio. The number of patents received by an engineer in the automotive sector and the place of the inventions where these patents are in the sector indicate the importance of the inventor in the sector, that is, inventors with good and successful patents take easy investment, in short, they are more considered in the sector.
